The Freedom Party proposes ten (10) changes to our Laws that require immediate Congressional Attention and Action:
1. NO OMNIBUS BILLS
Congressional gridlock and partisan politics is at its worst when Congress combines a myriad of legislation into a single “take it or leave it” bill.
The Freedom Party supports and endorses a “Line Item Veto” for the President to strike any individual provision of such Omnibus Bills. In the absence of a “Line Item Veto”, Congress should pass individual Bills for:
- Each Federal Agency or Department shall have its Budget or expenditure authorization issued separately from all other Agencies or Departments
- Each regulatory Bill shall be issued separately from any other agency regulatory Bill
2. INCOME TAX REFORM
The Freedom Party supports the wholesale revision of the Income Tax Code. As an illustrative draft position, we propose Congress start with the following concepts as Income Tax Reform legislation is developed:
- Two filing status: Separate or Joint
- No income is exempt, including short/long term capital gains on investments
- No dependent deductions
- No itemized deductions
- Zero tax on the first $60,000 (separate) or $120,000 (joint)
- Three Tax Brackets 15%, 25%, 40%
Self-Employed, Small Business, and Corporate Taxes
- Small Business no longer filed under individual owner at individual rates
- 16% flat tax rate
- Corporate Dividends are deductible to the company
3. PRICE GOUGING BY PHARMACEUTICAL COMPANIES
The Freedom Party supports Congressional legislation to address instances whereby Pharmaceutical Drug Companies charge one price for the US market and a lower price for non-US countries. In cases wherein the Pharmaceutical Company US final prices (amount accepted for the prescription, including insurance and/or Medicare discounts) are greater than 15% higher than the exchange-rate final price in any other country, violations shall be considered a Federal Felony and (1) a fine equal to two times the difference in gross proceeds shall be issued against the company, and (2) the Board of Directors and Executive Management of the Company shall go to jail for not less than 1 year (mandatory minimum sentence) but no more than 2 years.
4. WILLFUL MISCONDUCT BY STATE OR LOCAL JURISDICTION
The Freedom Party supports Congressional legislation to address instances where State or Local jurisdictions willfully refuse to comply with applicable Federal Law(s) which have primacy. In such cases, violations shall be considered a Federal Felony and: (1) the jurisdiction loses all Federal Funds until compliant; (2) responsible elected officials who voted for and passed the legislation shall go to jail for not less than 1 year (mandatory minimum sentence) but no more than 3 years; (3) if a felony is performed by a third-party, and lawful action by the State/Local official would have reasonably have prevented the felony, the official shall be guilty as an accessory in the felony.
5. TORT LAW AND MEDICAL MALPRACTICE
The Freedom Party supports Congressional legislation to create a Uniform Justice Code for Tort Law and Medical Malpractice.
- A “Maximum Award” chart shall be created which reflects uniform application of awards based on: Permanently Disabled requiring continuous lifetime care (max); Death benefit based on age at time of death and potential earnings; Permanently Disabled; Disabled for period less than 10 years; Discomforture.
- Attorney Fees are contingent, are awarded separately, and cannot exceed 10% of the award.
- Medical Malpractice “Burden of Proof” is raised to “Gross Negligence” from “Routine Standard of Care”.
- Attorney fees for “Class Action” lawsuits shall not exceed 300% of the maximum award granted to a single plaintiff.
6. FREEDOM OF RELIGION
The Freedom Party believes “Freedom of Religion” does not mean “Freedom from Religion”. Specifically, the Freedom Party supports legislation to explicitly define “Atheism” as a religion – which shall not be promoted or given priority over any other religion. The practice of “Atheism” shall be subject to the same Constitutional restrictions as any other religion.
Further, the Freedom Party acknowledges that the United States was founded as a Christian faith-based nation, which grants through the Constitution, each citizen the ability to practice each citizen’s own religious beliefs. The Freedom Party agrees with court decisions on public money not being spent on publicly owned land to erect/install religious symbols or scenes, and upon prohibiting public employees requiring participation in religious ceremonies or themes.
However, Congress should enact legislation, protecting any citizen’s right, including public employees, to individually worship as long as the activity is voluntary and in a non-disruptive manner.
Federal legislation should also explicitly clarify that religious laws do not supersede Local, State, and Federal law (e.g., polygamy, Sharia, et al), and “zones” may not be establish by any legislative authority within which religious laws are expected to take precedence.
The Freedom Party notes that History is full of examples of people moving to other countries for Religious reasons; and the Freedom Party fully supports the decision of any citizen to move to another country where the laws of another country are more compatible with their faith (e.g., polygamy, Sharia, et al).
Furthermore, it is contrary to our Constitutional Rights to find offense at an expression of “Happy Hanukah” or “Happy Ramadan Wishes” or “Merry Christmas”, etc. The Freedom Party encourages citizens to use the appropriate greetings and well wishes.
7. NATIVE AMERICAN INTEGRATION
The Freedom Party notes that there is no Federal Bureau of Asian Affairs (or Hispanic, etc.), or are any group of citizens assigned to “Asian Reservations” (or Hispanic, etc.), nor are any group of citizens granted “special rights”.
The Freedom Party acknowledges the culpability and role of the Democrat Party who had a Congressional majority and enacted legislation (over the objections of the Republican Party), in the long course of Native American history (i.e., Trail of Tears, et al).
Now, at this point in history, it is time to fully integrate Native Americans. The Freedom Party supports forming a Special Commission, with equal representation of Native American Tribes, to develop specific legislation to end the Bureau of Indian Affairs and transfer all currently designated lands (including mineral rights) to Native Americans. Formation of Limited Liability Corporations (LLCs) or Corporations may be more expedient in the establishment of land ownership among tribal members.
The Freedom Party supports a “Sunset Date” of January 1, 2020, for the transfer of all current “reservation” lands to Native Americans, and the beginning of full application of the Constitution and US Law to our Native American citizens.
8. BALANCED FEDERAL BUDGET AND LINE-ITEM VETO AMENDMENT
The Freedom Party supports a Constitutional Amendment to facilitate a balanced Federal budget as follows:
“EXCEPT IN TIMES OF WAR, THE US FEDERAL BUDGET SHALL NOT EXCEED FEDERAL INCOME, EXCLUDING SOCIAL SECURITY TRUST FUND INCOME AND EXPENDITURES. THE PRESIDENT SHALL HAVE THE POWER OF A LINE-ITEM VETO OF PROPOSED BUDGET EXPENDITURES. CONGRESS MAY OVERRIDE THE PRESIDENT’S LINE ITEM VETO OF A BUDGET EXPENDITURE BY A TWO-THIRDS MAJORITY VOTE.”
9. EXECUTIVE ACTIONS
The Freedom Party supports Federal legislation to curb the power of Presidential Actions as follows:
“The President shall have all proposed Executive Actions subject to a mandatory simple majority vote within 60 days of issuance of both houses of Congress to approve any proposed Executive Action”.
10. NATIONAL IDENTIFICATION CARD
In the United States, citizens have multiple cards and licenses issued by the government (on average greater than 5 of the following):
- Social Security Number and Card
- Driver’s License
- Vehicle Registration
- Voter Registration Card
- Gun License
- Hunting/Fishing License
- Medicare/Medicaid Card
- Health Insurance Cards, such as the Veteran Health Identification Card
- Military Identification Card
Since 2015, new technology allows a single “smart card” which can include photograph, biometrics (fingerprint, handprint, etc.), and can be linked to each of the above databases.
Identity and credit card theft is a major problem ($12B-$24B USD per year) and is a substantive factor in the inflated cost of goods and services (merchants have to account for stolen credit cards. Fraud in government services is also exacerbated by the lack of succinctly identifying the recipient, allowing fraud through multiple claims.
The Freedom Party supports Congressional action to create a National Identity Card (NIC), to be issued by the Social Security Administration to all applicants over a 3-year period (universal implementation by 2020). The NIC would be a “Smart Card” and include Biometrics with photo and chip technology, and once issued would supersede the need for other cards by being linked to the State Drivers License, Vehicle Registration, Gun Permit, Security Clearance, Voter Registration, Passport/Visas, and Hunting/Fishing License(s), Medicare/Medicaid Card, and applicable Health Insurance Card, etc.
The NIC will be a substantial barrier to identity theft and fraud, facilitate ease of identification, and the savings from all programs will cover the investment cost in implementation.
The Freedom Party notes that every piece of information listed above is ALREADY being collected by various governmental agencies and is already “share-able” between databases. Having the NIC will enable every citizen to have a convenient single “smart card”.
